Indonesia Finalizes Revision of Patent Law Number 13 of 2016

As an institution that provides patent protection, the Indonesian Ministry of Justice and Human Rights – Directorate General of Intellectual Property (DGIP) held a Working Committee Meeting to finalize the preparation of the Bill (RUU) on Amendments to Law Number 13 of 2016 (Patent Law Bill No. 13/2016) concerning Patents.
The Patent Law Bill No. 13/2016 is one of the 38 Bills agreed upon by the House of Representatives of the Republic of Indonesia (DPR) with the Ministry of Justice and Human Rights to enter the National Legislation Program (Prolegnas) together with the Industrial Design Bill.
The Patent Law Bill No. 13/2016 is included in the 2023 priorities since technical needs and readiness aspects have been prepared.
DGIP expects that the 38 main priorities in the National Legislation Program, especially the Patent Law Bill No. 13/2016 can be completed at the soonest. This Committee Meeting discussed national innovation, patent services, and the suitability of the Bill with international regulations. This finalization aims to strengthen the substance of the Bill.
The government has discussed each of the articles, made several revisions and added more articles. They also provide notes to synchronize the perception of the Patent Law Bill No. 13/2016.
As stated separately, the Pancasila Ideology Development Agency (BPIP) requests all parties involved in formulating the Patent Law Bill No. 13/2016 to fully support the said formulated Bill.
BPIP also stated that the Bill was drafted based on the state`s interests. Therefore, BPIP expects that Patent Law Bill No. 13/2016 will have a positive impact on the society. In principle, as long as individual interests can be ruled out, regulations should be able to provide benefits and protection to all.
Patent Law Bill No. 13/2016 is prepared to improve state services to the public, especially in the patent field, so that it can provide legal certainty for potential domestic and/or foreign applicants who want to protect its patent in Indonesia.
