Shopping Center and Mall Certification is Expected to Increase Investor`s Trust in Indonesia

In the Special 301 Reports issued by the United States Trade Representative (USTR) on April 28, 2022, Indonesia is still on a Priority Watch List (PWL) and Watch List (WL) since 1989. PWL is a list of countries that according to the USTR have a serious level of Intellectual Property (IP) infringements.

 

There are only 138 data on IP infringements handled by the Directorate General of Intellectual Property (DGIP), Indonesian Ministry of Justice and Human Rights which was recorded from 2019 to June 2022. While the number of state losses due to IP infringements from 2015 to 2020 was IDR 291 trillion.

 

DGIP is attempting to remove Indonesia from the PWL status published by the USTR. This aims to foster the trust of foreign investors in Indonesia which is in line with the request of President Joko Widodo so that Indonesia can facilitate the foreign investors by providing maximum support for IP enforcement.

 

As one of the efforts, DGIP launched an IP-Based Shopping Center and Mall Certification program. At the moment, the certification has already been given to 17 Shopping Centers and Malls, while 77 applications for Shopping Center and Mall certification are currently in the verification process.

 

The feasible criteria for Shopping Center and Mall verification are for those who trade goods and/or products that have already been filed in the DGIP, whether they are still in the application stage or have already been registered. Moreover, the goods and/or products that have been traded must not infringe any IP rights. At least 70% of tenants in the Shopping Center and Mall must trade genuine goods and/or products.

 

Shopping Center and Mall certification is expected not only to focus on Modern Shopping Centers but also on Traditional Shopping Centers, and provide a humanist approach such as conducting IP anti-counterfeiting socialization.

 

Shopping Center and Mall certification is also expected to be implemented in the district or city area which is the area of the industrial center. The DGIP needs to conduct regular monitoring and evaluation of the certified Shopping Center and Mall.
